Challenge Task 4: Browser Speed
To enter the fourth Challenge Task (Browser Speed), entrant must register/login and play the
BlackBerry-branded Wiki Game ("the Game") as indicated on the Site and posted at
http://blackberry.thewikigame.com,
in accordance with the terms below. Entrants can play multiple times. Points will be determined based on an algorithm which will be based on speed and
frequency of play. Entrants will be ranked on the leaderboard ("Leaderboard") according to
points. Entrants should check back to see how they rank on the Leaderboard which will be
located on
BBMchallenge.com. Entrants will have their words generated by the Wiki Games
platform. The highest-ranked entrant on the Leaderboard at the end of the Browser Speed
Challenge Period will be deemed the Winner (subject to confirmation).
Official plays of the Game must be submitted between 12:00:01 AM Pacific Time on May 24,
2012 and 11:59:59 PM Pacific Time on June 6, 2012 ("Browser Speed Task Challenge Period")
for entry to be considered.
Sponsor may prohibit an entrant from playing the Game or winning a prize if, in its sole
discretion, Sponsor determines that said participant is attempting to undermine the legitimate
operation of the Game by cheating, hacking, deception, or other unfair playing practices
(including the use of script, macro or other automated quick entry programs or any means which
subvert the game play process) or intending to annoy, abuse, threaten or harass any other entrants
or Sponsor's representatives and all associated Game plays will be void. Sponsor will interpret
these Official Rules and resolve any disputes, conflicting claims or ambiguities concerning these
Official Rules or the Game and the Sponsor's decisions concerning such disputes shall be final
and binding.
One (1) Browser Speed Challenge Winner will be selected based on the highest ranked person
on the Leaderboard at the end of the Challenge Term. Potential winner will be notified of his/
her winner status via email and/or phone by within seven (7) days of the close of the Browser
Speed Challenge Period. Potential winner and guest (or his/her parent or legal guardian if
such entrant or guest is a minor in his/her jurisdiction of residence) may be required to sign
and return, where legally required, an Affidavit/Declaration of Eligibility, Liability/Publicity
Release and/or rights transfer document within five (5) calendar days of prize notification. For
additional details and terms regarding notification and prizing, see Official Rules posted at
http://bbmchallenge.blackberry.com/terms-conditions.
The Browser Speed Challenge Winner will be able to select one (1) guest to attend a sporting
event in the United States or Canada, as determined by Sponsor in its sole discretion. Mr.Youth
will work with Winner to determine and approve type of sporting event, date of sporting event,
and teams or players participating in event. The specific sporting event will be based on
Winner’s schedule and ticket availability and will ultimately be determined by Mr. Youth and
Sponsor. Country of residence will not determine the applicable film festival. Winner and guest
are responsible for obtaining all required travel documents, including passports and visas (if
applicable) prior to travel. Potential winner and guest (or his/her parent or legal guardian if such
entrant or guest is a minor in his/her jurisdiction of residence) may be required to sign and return
an additional Release prior to prize fulfillment.
Prize for the Browser Speed Challenge Winner will include one (1) round-trip coach airfare
from major gateway airport nearest Winner’s city of residence for Winner and one (1)
guest, transportation to and from the nearest major gateway airport, double occupancy hotel
accommodations, $500 USD/$500 CDN spending money for Winner and sporting event tickets
for Winner and guest. Winner and guest will also receive new BlackBerry 7 devices (service not
included). Taxes, meals, gratuities, travel upgrades or any other expenses not specifically listen
herein are responsibility of Winner and guest.
Approximate Retail Value ("ARV") of prize: $6,000 USD/ $6,010 CDN, but actual value may vary
depending on air flight fluctuations and distance between departure and destination, and prize will
not exceed a value of $8,000 USD/ $8,013 CDN. Winner will not receive difference between actual
and approximate retail value.
Prize must be fulfilled before October 31, 2012; or prize will be forfeited and may be awarded to
an alternate.

By entering, each entrant (or his/her parent or legal guardian if such entrant is a minor in his/her
jurisdiction of residence) agrees to be bound by these Official Rules & Regulations ("Official
Rules") and the decisions of the Sponsor (as defined below) and judges, which are final and
binding. These Official Rules will apply to the BBM™ Challenge Council Project ("Challenge")
including the challenge tasks that are a part thereof ("Challenge Tasks"). By entering this
Challenge, each entrant (or his/her parent or legal guardian if such entrant is a minor in his/her
jurisdiction of residence) is deemed to have accepted these Official Rules and any additional
terms and conditions, including information regarding prizes and how to enter Challenge Tasks,
posted at
http://bbmchallenge.blackberry.com (the "Site"),
http://bbmchallenge.blackberry.com/terms-conditions (the "Official Rules") and
http://bbmchallenge.blackberry.com/contest-rules (the "Challenge Task Rules"), which additional terms and conditions shall also be deemed part of these Official Rules.
1. Challenge Period
The Challenges begin at 12:00:01 AM Pacific Time on April 12th, 2012 and end at 11:59:59
PM Pacific Time on June 20th, 2012 ("Challenge Period"). Every two and a half weeks
(approximately) during the Challenge Period, a Challenge Task will be announced on the Site.
The start date ("Challenge Task Start Date") and end date ("Challenge Task End Date") of each
Challenge Task ("Challenge Task Period") will also be posted on the Site with the explanation of
the Challenge and its related prizing ("Challenge Announcement").
2. Eligibility
Participation open only to legal residents of the fifty United States or the District of Columbia
and Canada (excluding residents of Quebec), who are 13 or older as of date of entry. Void in
Quebec, outside of the fifty United States, the District of Columbia, and Canada, and where
prohibited or restricted by law. Employees, officers and directors of Research In Motion Limited
("Sponsor"), Mr. Youth, LLC ("Mr. Youth") and their respective parent companies, subsidiaries,
affiliates, partners, advertising and promotion agencies, manufacturers or distributors of
Challenge materials, and their immediate families (parents, children, siblings, spouse) or
members of the same household (whether related or not) of such employees/officers/directors are
not eligible to enter. Subject to all applicable federal, state, provincial/territorial and local laws
and regulations.
3. How to Enter
To enter the Challenge, go to the Site and follow the links and instructions to enter. Read the
Official Rules and complete the online entry form (including your name, mailing address, phone
number, birth date, and email address, plus guardian contact information if you are a legal
minor). You must register for the Challenge in order to participate in any Challenge Tasks.
Information regarding how to enter each Challenge Task will be posted on the Site with the
Challenge Announcement. All entry information and any other information and/or materials
submitted with respect to Challenge Tasks (e.g., videos, photos, essays, etc.) shall be collectively
referred to herein as the "Submissions" or each as a "Submission."
Entrants may participate in multiple Challenge Tasks during the Challenge Period but are not
required to do so. Limit one (1) Submission per person/email address for each Challenge Task.
For sake of clarity, entrants can only use one email address to enter the Challenge. Submissions
must comply with the Guidelines and Restrictions defined below. Sponsor reserves the right to
cancel or modify the Challenge or any Challenge Task in the event an insufficient number of
Submissions are received that meet the minimum judging criteria for each Challenge Task.
Entrants who are minors in their jurisdiction of residence (e.g., under 19 years of age in
Alabama, Nebraska, British Columbia, New Brunswick, Nunavut, Northwest Territories, Nova
Scotia, Yukon and Newfoundland and Labrador and under 21 in Mississippi, and under 18
years of age everywhere else) will be required to provide, at time of entry, their parent or legal
guardian's name, email address and phone number so Sponsor can send minor's parent or legal
guardian a link to Sponsor’s release for minors ("Minor Release"), which must be agreed to
by minor's parent or legal guardian in order for the minor to be eligible to participate in the
Challenge. Minor's Submission will not be posted until after minor's parent or legal guardian
agrees to the Minor Release. If minor's parent or legal guardian does not agree to the Minor
Release before the end of the relevant Challenge Task Period, minor's Submission for such
Challenge Task will be disqualified.
By entering, each entrant (or his/her parent or legal guardian if such entrant is a minor in his/
her jurisdiction of residence) warrants and represents the following with respect to entrant’s
Submission: (a) entrant is the sole and exclusive owner of the Submission; (b) the Submission
is entrant's own creation; (c) the Submission will not infringe on any rights of any third parties,
including without limitation, any privacy, publicity, confidentiality, contractual, copyright,
trademark, or other intellectual property, proprietary property or other rights; (d) the Submission
has not been entered into any other contest or promotion or won any award; (e) Submission has
not been previously published in any form; and (f) any third parties appearing in or referenced in
the Submission have given entrant appropriate written consent (including for minors appearing
in the Submission, consent of any such person’s parent/legal guardian) to be filmed, named,
photographed and/or used in connection with this Challenge. Sponsor reserves the right to
request third party releases from any third party included in any Submission at any time. Failure
to produce fully executed third party releases (if applicable) may result in disqualification of the
Submission, in Sponsor's sole and absolute discretion.
By entering and/or participating, each entrant (or his/her parent or legal guardian if such entrant
is a minor in his/her jurisdiction of residence) grants Sponsor the right, but not the obligation,
to use entrant's name, address (city and state/province/territory), likeness, photograph, picture,
portrait, voice, biographical information, Submissions, and/or any materials or information
provided by entrant regarding the Challenge or statements made by each entrant regarding the
Challenge or Sponsor for advertising and promotional purposes without notice or additional
compensation, except where prohibited by law, throughout the world, in perpetuity, for any
purpose whatsoever, including advertising, publicity and trade, in any and all media, including
but not limited to on any and all Internet media including Sponsor's web sites and properties and
on social networking sites (i.e., Facebook, YouTube, Twitter, etc.).
Providing a Submission constitutes entrant's consent (or his/her parent or legal guardian’s
consent if such entrant is a minor in his/her jurisdiction of residence) to give Sponsor a royalty-
free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create
derivative works from, and display such Submissions in whole or in part, on a worldwide basis,
and to incorporate it into other works, in any form, media or technology now known or later
developed, including for promotional or marketing purposes. Further, each entrant hereby
waives all moral rights in and to his/her Submission(s) in favor of Sponsor to the fullest extent
permitted by law.
All entrants must have a valid email address and Facebook account. No automated entry devices
and/or programs permitted. All entries, including Submission materials, become the sole and
exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned.
Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible,
misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems
of any kind whether mechanical, human or electronic. Only fully completed entry forms are
eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
4. Challenge Tasks
Each Challenge Task will be posted on Site with the Challenge Announcement during the
applicable Challenge Task Period. Each Challenge Task will relate to a BlackBerry-relevant
category (each a "Challenge Task Topic") specified by Sponsor. For each Challenge Task, the
following will be posted on the Site:
- Description of the Challenge Task
- How to participate in the Challenge Task
- Challenge Task Start Date and Challenge Task End Date
- Submission uploader (if applicable to the Challenge Task)
- Gallery of Submissions (once they have been moderated) with the ability to share/like (if applicable to the Challenge Task)
- All prize details and conditions, including a description and number of prizes
- Winner of the Challenge Task (after winner confirmation, time permitting)
There will be a total of five (5) Challenge Tasks during the Challenge Period. To participate in
any specific Challenge Task, entrants must comply with the Challenge Task instructions posted
on the Site.
5. Submission Guidelines and Content Restrictions
By entering, each entrant (or his/her parent or legal guardian if such entrant is a minor in his/
her jurisdiction of residence) agrees that his or her Submission conforms to the Submission
Guidelines and Content Restrictions as defined below (collectively, the "Guidelines and
Restrictions") and that Sponsor or Mr. Youth, in their sole discretion, may remove any
Submission and disqualify an entrant from the Challenge if they believe, in their sole discretion,
that the entrant's Submission fails to conform to the Guidelines and Restrictions. However,
Sponsor or Mr. Youth may, in their sole and absolute discretion, notify entrant of entrant's
non-compliant/disqualified Submission and give the entrant the opportunity to submit another
Submission that is compliant with these Guidelines and Restrictions in accordance with these
Official Rules.
Submission Guidelines:
- Submissions must be in English.
- Other Submission guidelines for each Challenge Task will be posted on the Site and entrant must comply with such Challenge Task guidelines.
Content Restrictions:
- Submissions cannot be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
- Submissions cannot promote illegal drugs or firearms (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous, or any particular political agenda or message;
- Submissions cannot be obscene or offensive, endorse any form of hate or hate group;
- Submissions cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies;
- Submissions cannot advertise or promote any brand or product of any kind (other than those owned by Sponsor), without permission, or contain any third party personal identification, such as license plate numbers, personal names, email addresses or street addresses;
- Submissions cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission of the owner;
- Submissions cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any other person, living or dead, except for third parties for whom entrant has a third party release;
- Submissions cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
- Submissions cannot depict, and cannot itself, be in violation of any law;
- Submissions cannot violate any applicable Terms of Service (or Terms of Use) of Facebook or Viddler.
- Submissions must not include, discuss or otherwise involve any other content that is or could be considered inappropriate, unsuitable, or offensive in any way, all as determined by Sponsor and/ or Mr. Youth in its/their sole discretion.
Each entrant acknowledges that other entrants may have used ideas and/or concepts in their
Submission that may be similar in idea or concept to what is included in entrant's Submission.
Each entrant understands and agrees that he/she shall not have any claim against any other
entrant or Sponsor arising out of any such similarity or be entitled to any compensation because
of any such similarity.
Sponsor's decisions are final and binding in all matters relating to this Challenge, including, but
not limited to, interpretation and application of these Official Rules. By entering the Challenge,
each entrant (or his/her parent or legal guardian if such entrant is a minor in his/her jurisdiction
of residence) fully and unconditionally agree to be bound by these Official Rules and the
decisions of the judges, which will be final and binding in all matters relating to the Challenge.
Submissions are deemed to be received at the time of receipt into Sponsor's server, not at the
time of transmission by an entrant. Entrants who enter using multiple email addresses, aliases or
other identification may be disqualified in Sponsor's sole discretion.
6. Judging/Judging Criteria
All eligible Submissions for each Challenge Task will be judged by Sponsor and Mr. Youth.
Except for Challenge Task 5, all eligible Submissions will be judged by judges based on the
following equally-weighted judging criteria in each Challenge Task: (a) Creativity (25%), (b)
Compelling response to Challenge Task Topic (25%), (c) Enthusiasm (25%), and (d) Passion
for the BlackBerry brand (25%). Except for Challenge Task 5, in the event of a tie, tie will be
broken based on higher score in the "Compelling response to Challenge Task Topic" category.
If there is still a tie, tie will be broken based on higher score in the "Creativity" category.
Judging of each Submission will take place approximately one day after the applicable Challenge
Task End Date. Challenge Task 5 winner will be determined based on the highest ranking on
the leaderboard, located at BBMchallenge.com, as determined by Game play, at the end of
the Challenge 5 Challenge Period (subject to confirmation), as set forth in the Challenge Task
Rules. The potential winner(s) of a Challenge Task will be notified on or about the date stated
in the applicable Challenge Task Rules, which should be approximately within one week of the
applicable Challenge Task End Date. The winner(s) of each Challenge Task (upon confirmation)
and the winner(s)’ guest(s) (if applicable) must receive or redeem the prize for such Challenge
Task within the dates set forth in the Challenge Task Rules for such Challenge Task or the prize
will be forfeited or may be awarded to an alternate eligible entrant, in accordance with these
Official Rules.
7. Prizes
There will be five (5) prizes available during the Challenge Period, ranging in Approximate
Retail Value between $6,000 USD or $6,010 CDN and $10,000 USD or $10,016 CDN per prize.
One (1) prize for each applicable Challenge Task. The Approximate Retail Value ("ARV") of
such prize(s) and any terms and conditions on such prize(s), not otherwise stated in these Official
Rules, will be posted on the Site or in the Challenge Task Rules.
Prizes are non-transferable. No substitutions or cash redemptions, except in the case of
unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or
greater value. All expenses not specifically listed herein or the Challenge Task Rules are the
responsibility of winner. Sponsor is not liable for any tax implications arising out of prize
acceptance and use. Winner is responsible for all federal, state, provincial, territorial and local
taxes and any other costs and expenses associated with prize acceptance and use not specified
herein as being provided. Independent financial advice should be sought. All prize details are at
Sponsor's sole discretion. While the specific prize(s) for each Challenge Task will be posted on
the Site, the following terms apply to certain categories of prizes:
a) Trip Prizes: If the prize is a trip, unless otherwise stated on the Site or the Challenge Task
Rules, the following terms and conditions apply:
Trip includes round-trip coach airfare from major gateway airport nearest the winner's
city of residence, transportation to and from the nearest major gateway airport and hotel
accommodations. Taxes, meals, gratuities, travel upgrades, or any other expenses not specifically
listed herein are the responsibility of winner. Travel and accommodations subject to availability;
certain restrictions and blackout dates may apply. Winner must travel between specified dates,
or prize will be forfeited and may be awarded to an alternate. If winner is a minor in his/her
jurisdiction of residence, one guest must be winner's parent or legal guardian. Guest must be
of the age of majority unless the winner is guest’s parent or legal guardian or guest’s parent or
legal guardian has provided appropriate consent to Sponsor, as determined by Sponsor in its
sole and absolute discretion. Winner and guest(s) must travel on the same itinerary including
the same departure airport, departure date, destination and return date, and must have a valid
passport, a valid required visa and other travel documents, the expense of which the winner is
solely responsible for, prior to departure, and failure to do so will result in forfeiture of prize.
Winner and guest(s) must sign travel release prior to ticketing. Sponsor is not liable for delays,
cancellation or unforeseen events related to the flights. Winner and guest(s) will be solely
responsible for obtaining valid identification relating to acceptance and use of the travel prize
packages. If in the judgment of Sponsor, air travel is not required due to winner's proximity
to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor's
sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers
or certificates. Actual value may vary depending on air flight fluctuations and distance between
departure and destination. Winner will not receive difference between actual and approximate
retail value.
b) BlackBerry Smartphone Prizes: If the prize is a BlackBerry smartphone, unless otherwise
stated on the Site or the Challenge Task Rules, the following terms and conditions apply:
Phone service is not provided as part of the smartphone prize. Smartphone prizes are
awarded "as is" with no warranty or guarantee, either express or implied, by Sponsor. Winner
acknowledges and agrees that:
- the smartphone prize will not operate without activation, airtime and other services which are not included with the BlackBerry smartphone prize;
- Winner shall be responsible for the set up and payment of any monthly airtime service fees associated with the smartphone prize as well as any other applicable set up or other applicable fees in order to activate and use the smartphone prize;
- use of the smartphone is subject to acceptance of the BlackBerry End User License Agreement provided with the smartphone;
- the use of the third party products and services on the smartphone prize is subject to terms and conditions, including, if applicable, any license agreement provided with the third party software, hardware, products and/or services (collectively, the "Third Party Information");
- the use of Third Party Information shall be governed by and subject to winner’s agreement to the terms of separate Third Party Information licenses and/or agreements;
- any Third Party Information that is provided with or without Sponsor's products and/ or services is provided "as is". Sponsor makes no representation, warranty or guarantee whatsoever in relation to the Third Party Information and Sponsor assumes no liability whatsoever in relation to the Third Party Information even if Sponsor has been advised of the possibility of such damages or can anticipate such damages;
- the inclusion of Third Party Information does not imply endorsement by Sponsor of the Third Party Information or the third party in any way; and
- Sponsor does not control and is not responsible for any Third Party Information, including without limitation, the content, accuracy, intellectual property issues, compatibility, performance, trustworthiness, legality, decency, links, or any other aspect of the Third Party Information.
c) Event Prizes: If the prize is access to an event, unless otherwise stated on the Site or the
Challenge Task Rules, the following terms and conditions apply:
Neither Sponsor nor Mr. Youth will replace any lost or stolen prize and/or any lost, mutilated
or stolen tickets, passes, vouchers or certificates. The game, event or exhibition dates and times
are determined in the sole discretion of the ticket issuer and may be subject to change. Winner
and his/her guest(s) agree to comply with all ticket terms and all applicable regulations in
connection with the ticket prize. Sponsor and the ticket issuer reserve the right to remove or to
deny entry to winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive
manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or
exhibition. Neither Sponsor nor Mr. Youth is responsible if the event prize is delayed, postponed
or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and
no substitution will be provided except as in Sponsor’s sole discretion. If winner is considered
a minor in his/her jurisdiction of residence, one guest must be his/her parent or legal guardian.
Winner(s) will be responsible for all costs and expenses in connection with the Event Prize not
expressly included on the Site or the Challenge Task Rules.
8. Notification
The winner(s) of each Challenge Task will be notified by email and phone within one week of
the Challenge Task End Date and may be required to sign and return, where legal, an Affidavit/
Declaration of Eligibility, Liability/Publicity Release and/or rights transfer document within five
(5) calendar days of prize notification. If any winner is considered a minor in his/her jurisdiction
of residence, Affidavit or Declaration of Eligibility, Liability/Publicity and rights transfer
document must be signed by his/her parent or legal guardian. If any winner cannot be contacted
within five (5) calendar days of first notification attempt, if any prize or prize notification is
returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance
with these Official Rules, such prize will be forfeited and may be awarded to the Submission
with the next highest score. Upon prize forfeiture, no compensation will be given.
9. Conditions
Sponsor shall not be liable or responsible in the event any Submission is not used for any reason.
Submissions may be cut, edited, reformatted, rearranged, combined with other materials and/
or otherwise modified, in Sponsor's sole and absolute discretion. By participating, entrants
and winners agree to release and hold harmless Sponsor, Mr. Youth, Facebook Inc., and
their respective advertising and promotion agencies and their respective parent companies,
subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers
and directors (collectively "Released Parties"), from any and all liability, for loss, harm,
damage, injury, cost or expense whatsoever including without limitation, property damage,
personal injury and/or death which may occur in connection with, preparation for, travel
to, or participation in Challenge, or possession, acceptance and/or use or misuse of prize or
participation in any Challenge-related activity and for any claims based on publicity rights,
defamation, invasion of privacy, copyright infringement, trademark infringement or any other
intellectual property-related cause of action. Entrants who do not comply with these Official
Rules, or attempt to interfere with this Challenge in any way, shall be disqualified. Sponsor is
not responsible if Challenge cannot take place or if any prize cannot be awarded due to travel
cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or
acts of terrorism.
10. Additional Terms
Any attempted form of entry other than as set forth above is prohibited; no automatic,
programmed; robotic or similar means of entry are permitted. Released Parties are not
responsible for technical, hardware, software, telephone or other communications malfunctions,
errors or failures of any kind, lost or unavailable network connections, web site, Internet, or
ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate
capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or
delayed computer transmissions which may limit one's ability to enter the Challenge, including
any injury or damage to participant's or any other person's computer or other device relating to
or resulting from participating in this Challenge or downloading any materials in this Challenge.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend
this Challenge should (in its sole discretion) virus, bugs, non-authorized human intervention,
fraud or other causes beyond its control corrupt or affect the administration, security, fairness or
proper conduct of the Challenge. In such case, Sponsor will select the winners from all eligible
entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor
reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion,
to be tampering with the entry process or the operation of the Challenge or web site. Sponsor
may prohibit an entrant from participating in the Challenge or winning a prize if, in its sole
discretion, it determines that said entrant is attempting to undermine the legitimate operation
of the Challenge by cheating, hacking, deception, or other unfair playing practices (including
the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any
other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB
SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE MAY BE
A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE
MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH
PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to any Submission, the authorized account holder of the email address
used to register will be deemed to be the entrant and must comply with these Official Rules.
The "authorized account holder" is the natural person assigned an email address by an Internet
access provider, online service provider or other organization responsible for assigning email
addresses for the domain associated with the submitted address. Each entrant may be required to
show proof of being an authorized account holder.
11. Limitation of Liability; Disclaimer of Warranties
IN NO EVENT WITH THE SPONSOR, MR. YOUTH, ANY AGENCIES, SUPPLIERS,

IN ANY WAY, FACEBOOK, AND THEIR RESPECTIVE PARENT COMPANIES,
SUBSIDIARIES, AFFILIATES, ADVERTISING AND MARKETING AGENCIES,
REPRESENTATIVES AND ENTITIES INVOLVED IN THE IMPLEMENTATION AND
EXECUTION OF THE CHALLENGE (THE "RELEASED PARTIES") BE RESPONSIBLE
OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT,
INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING
OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE CHALLENGE,
DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM
ANY WEBSITES ASSOCIATES WITH THE CHALLENGE. IN NO EVENT SHALL THE
RELEASED ENTITIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES,
OR CAUSES OF ACTION EXCEED $10. WITHOUT LIMITING THE FOREGOING, THIS
CHALLENGE AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY

ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR
CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME
OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK

12. Disputes; Governing Law
Except where prohibited by law, the parties waive all rights to trial in any action or proceeding
instituted in connection with these Official Rules, including, without limitation, the Challenge.
Any controversy or claim arising out of or relating to these Official Rules and/or the Challenge
shall be settled by binding arbitration in accordance with the commercial arbitration rules of
the American Arbitration Association. Any such controversy or claim shall be arbitrated on an
individual basis, and shall not be consolidated in any arbitration with any claim or controversy of
any other party. The arbitration shall be conducted in the State of New York, City of New York.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE
GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE
STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.
For any matters which are not subject to arbitration as set forth in these Official Rules and/or
in connection with the entering of any judgment on an arbitration award in connection with
these Official Rules and/or the Challenge, the parties irrevocably submit and consent to the
exclusive jurisdiction and venue of the state and federal courts located in or closest to the County
of New York in the State of New York. The parties agree not to raise the defense of forum non
convenience.
13. Personal Information
By completing and submitting the information requested for participation in the Challenge,
entrants consent to the collection, use and disclosure of their personal information for the
purposes of this Challenge. Sponsor may disclose entrants' personal information to its contractors
and agents to assist in conducting this Challenge or communicating with entrants. If an entrant
has so elected, Sponsor may use this information for future contest and marketing purposes
regarding its products, including contacting the entrant via electronic messaging. The collection,
use and disclosure of any personal information entrants provide is subject to Sponsor's Privacy
Policy which is set out at:
